Terms & Conditions for Clients Month to Month & Flat Rates

  Effective Date: November 20 / 2024 

These Terms of Service (“Agreement”) govern the provision of digital design and copywriting services (“Services”) by Krystal Designs ("we", "us", "our") to any client ("you", "your"). By using our services, you agree to these Terms.

 We offer services including but, not limited to:

• Website design and customization using GoDaddy templates or website builder
• Logo and brand design
  Marketing copy, sales copy, and website content writing
• SEO-oriented writing
• Other related creative and strategic content services

Custom scope of work is outlined in project proposals or quotes.

 You agree to:

• Provide accurate and complete information in a timely manner
• Review and approve drafts, designs, and content within agreed timelines
• Ensure you have the rights to use all materials you provide to us
• Pay all fees as outlined in your invoice or agreement
   

•  Project fees are outlined in our proposal or quote.
  
• A 50% deposit is required before work begins, with the balance due upon completion.
  
• Additional charges may apply for revisions beyond the included rounds, rush jobs, or scope changes.
  
• Late payments may be subject to a  2% monthly interest fee.
  

 If your website is built using GoDaddy or integrated with other third-party tools, you acknowledge that:

• We are not responsible for the performance, uptime, or limitations of the GoDaddy platform or its services.
  
• You are responsible for your GoDaddy hosting, domain, and account credentials unless we have agreed to manage them on your behalf.
  
• We may require access to your GoDaddy account to complete our services.
  

•  You will own the final approved designs and copy upon full payment.
  
• We retain the right to showcase the work in our portfolio unless you request otherwise in writing.
  
• Drafts, concepts, and unused creative assets remain our intellectual property unless otherwise agreed.
  

• Includes Unlimited rounds of revisions per deliverable.
  
• Additional revisions are billed at hourly Rate or as agreed. 

 We will communicate delivery timelines during the project kickoff. Timelines may shift due to delays in client feedback or changes in scope.

•  Either party may terminate this agreement with written notice.
  
• If you cancel after work has begun, you are responsible for all work completed up to the date of termination.
  
• Deposits are non-refundable unless agreed otherwise.
  

•  We do not guarantee specific business outcomes (e.g., increased traffic, conversions, or revenue).
  
• We are not responsible for technical issues caused by GoDaddy or third-party platforms.
  
• Our services do not constitute legal, financial, or professional advice.
   

 We are not liable for any indirect, incidental, or consequential damages arising from the use of our services. Our total liability will not exceed the total amount paid by you for the services rendered.

These Terms shall be governed by and construed in accordance with the laws of British Columbia, Canada.
